The Oath Spoken Aloud — Kurukan Fuga, c. 1236

the dry season of about 1236 — the clans of the upper Niger gathered on a cleared plain after the founding of Mali, clan heads and hunters seated in ranks, a griot reciting the oath phrase by phrase and the crowd answering each line

A rule is only a rule once it has been said out loud in front of everyone. This breach reads the WATER-CARRIER AT THE BACK OF THE CLEARING at Kurukan Fuga: the dry-season assembly on the plain above the Niger, clan heads and hunters in their ranks, a griot giving the oath a phrase at a time and the whole gathering answering each phrase back to him. The witness is read only at the back, among the jars and the gourds: the politics and the long negotiations held softly in the background, never staged, the moment itself the carrying of a voice further than a voice should go. The fragment is the subject's own: the day words spoken by someone else landed in them as their own instruction — and the memory beneath it of a rule they were taught by hearing it said aloud, and have never once been able to unhear.

Malian oral tradition holds that after the founding of Mali the clans assembled on a cleared plain called Kurukan Fuga, in the dry season, to set out the terms of the new order
the assembly is remembered as a gathering of clan heads and hunters seated in ranks, with the clans given assigned places on the ground
the terms were transmitted and preserved orally by griots, recited in performance rather than read from a document
the recited tradition includes provisions on the treatment of travellers and strangers, on the sparing of certain persons in war, and on the protection of cultivated land and crops from burning
the recitations were held in the open air before a large assembled crowd, the lines given by the reciter and answered by those gathered
water was carried to such open-air assemblies in earthen jars and passed among the standing crowd in gourds
